Charges related to a fatal shooting in Superior on New Year's Day last year have been dismissed against a Duluth man.
Jamar Smith, 26, was charged with felony possession of a firearm, as well as bail jumping.
Smith was allegedly involved with the incident where Kyle Androsky, 21, was shot behind the Third Base Bar, however he was not charged with homicide.
According to the Douglas County District Attorney, the charges were dropped after the state received additional information from a primary witnesses, which they expect to have a significant impact on that witness's testimony.
The investigation is still open, and since the case was dismissed without prejudice, Smith could be charged again in the future.
Smith is in custody on bail for other charges unrelated to the shooting.
