ST. PAUL, MN (AP) -- The Minnesota attorney general's office says Senate President Michelle Fischbach cannot keep her Senate seat when she becomes lieutenant governor.
The legal opinion says an 1898 decision by the Minnesota Supreme Court that the GOP has referenced is no longer valid.
But it notes only a court can decide the dispute.
Fischbach expects to keep Senate seat when she becomes Gov. Mark Dayton's lieutenant governor.
Dayton has appointed current Lt. Governor Tina Smith to take Senator Al Franken's place.
